Terms of service

These terms govern purchases of Terms of Mercy from Samuel Alejandro (the "Seller"). By placing an order, you agree to these terms and to the policies linked at checkout.

1. The product

The product is one downloadable EPUB ebook. No printed book, subscription, membership, or continuing service is included. The product description, format, content note, compatibility information, price, taxes, and total shown at checkout form part of the agreement.

2. Personal-use licence

Purchase gives you a personal, non-exclusive, non-transferable right to download, keep, back up, and read the ebook on devices you own or control. Copyright remains with Samuel Alejandro. You may not resell, share, upload, publish, distribute, sublicense, or commercially exploit the file, or remove rights information from it.

3. Orders, price, currency, and taxes

An order is accepted when payment succeeds and an order confirmation is issued. The checkout total is the price payable. Taxes are charged where required. Your card issuer or payment provider may apply currency-conversion or other fees that the Seller does not control. We may refuse or cancel an order before delivery where payment fails, fraud is suspected, the price or listing contains an obvious error, or fulfilment is impossible. If we cancel a paid order before delivery, we refund the amount received.

4. Delivery

Delivery is electronic through Shopify and the configured digital-delivery service. You are responsible for providing a working email address and maintaining access to it. If the delivery link fails or the supplied file is damaged, contact samuel.alejandro@refura.eu with the order number and checkout email. After verification, we will provide a replacement link or file at no additional charge.

5. Format and compatibility

The product is supplied as EPUB. It is intended for Apple Books, Kobo devices and compatible apps, and EPUB readers on supported phones, tablets, and computers. Kindle users must use Amazon's Send to Kindle service; Kindle devices do not directly open EPUB files. A disclosed compatibility limitation, failure to follow setup instructions, or a problem caused by the buyer's device, app, account, connection, or third-party service does not create a refund right except where mandatory law requires otherwise.

6. Immediate delivery, withdrawal, and refunds

The refund and withdrawal policy displayed at checkout applies. Digital sales are final once delivery or download begins, to the fullest extent permitted by law.

For consumers in the European Union, European Economic Area, and United Kingdom, where checkout asks you to request immediate supply, your confirmation means that you expressly request delivery during any withdrawal period and acknowledge that the right to withdraw is lost once performance begins following that confirmation. If the consent, acknowledgment, or contract confirmation required by applicable law is not obtained, your non-waivable statutory rights remain.

For buyers elsewhere, no change-of-mind return or refund is offered for a correctly supplied and usable digital file, except to the minimum extent required by mandatory local law. Failed links and damaged files are remedied by replacement first. Nothing in these terms excludes consumer guarantees or other rights that cannot legally be excluded.

7. Customer responsibilities and prohibited conduct

You must provide accurate order information, use a payment method you are authorized to use, and keep the download and order details secure. You must not obtain the file through fraud, chargeback abuse, unauthorized payment, automated interference, or any unlawful act. We may restrict replacement delivery or support where an order cannot be verified or abuse is reasonably suspected, without limiting non-waivable rights.

8. Intellectual property

All text, cover art, design, branding, and other material supplied with the ebook remain protected by applicable intellectual-property law. No ownership is transferred. Any permitted quotation, review, or other use under applicable law remains unaffected.

9. Availability and changes

We may correct descriptions, prices, typographical errors, and technical problems, or withdraw the product from future sale. Changes do not alter a completed purchase retroactively. If a correction materially affects an unfulfilled paid order, we will notify the buyer and, where required, offer cancellation and a refund.

10. Liability

To the fullest extent permitted by law, the Seller is not liable for indirect, incidental, special, or consequential loss, or for loss caused by the buyer's device, software, internet connection, third-party reading service, unauthorized sharing, or failure to keep a backup. Where liability can lawfully be limited, total liability relating to an order is limited to the amount paid for that order. Nothing limits liability that cannot legally be limited, including liability for fraud, wilful misconduct, or death or personal injury caused by negligence where applicable.

11. Governing law and consumer jurisdiction

These terms are governed by Polish law. If you are a consumer in another country, this choice does not deprive you of mandatory protections or access to courts that the law of your habitual residence gives you. Any dispute will be handled by the courts having jurisdiction under applicable law.

12. Severability

If any provision is invalid or unenforceable, it is limited or removed only to the extent necessary. The remaining provisions continue to apply.
